About these terms

Question Avenue is operated by Megakad XD Ltd, whose address is below. In these terms, “we”, “us” and “our” mean Megakad XD Ltd, and “you” means the person using Question Avenue.

71-75 Shelton Street, London WC2H 9JQ, United Kingdom

By creating an account or using the Question Avenue app or website, you agree to these terms. If you do not agree, please do not use Question Avenue. Our Privacy Policy explains how we handle your information and forms part of how we provide the service.

02

Who can use Question Avenue

You must be at least 13 years old to use Question Avenue. The app asks for your date of birth and does not let anyone under 13 continue. Please give your real date of birth.

If you are under 18, or under the age of legal adulthood where you live, you should review these terms with a parent or guardian. Where the law in your country requires a parent’s or guardian’s consent for you to use an online service or make a purchase, you may use Question Avenue only with that consent. A parent or guardian who allows a young person to use Question Avenue is responsible for that use and for any purchases.

03

Your account

You sign in with Apple or Google. Your Question Avenue account is linked to the Apple or Google identity you choose, so keeping that account secure keeps your learning secure too.

  • Your account is personal to you. Please do not share it, sell it or let others use it.
  • You are responsible for activity that takes place through your account.
  • Tell us promptly at support@questionavenue.com if you think someone else has accessed your account.
04

Free access, subscriptions and billing

Question Avenue has a free plan with a limited number of courses; the app shows what it includes and what you have left. We may change what the free plan includes in the future, and we will not remove course material you have already generated because of that change.

Paid plans are auto-renewing subscriptions bought inside the app through Apple’s App Store. Apple processes the payment, and our subscription provider, RevenueCat, tells us which plan you have. We never receive your full payment-card details.

  • Price. The price, billing period and what each plan includes are shown in the app and on Apple’s purchase screen before you confirm. Prices may vary by country and include any taxes Apple applies.
  • Auto-renewal. Your subscription renews automatically at the end of each billing period, and Apple charges your App Store account, unless you turn off auto-renewal at least 24 hours before the current period ends.
  • Promotional and introductory prices. Some plans may be offered at a promotional or introductory price. That price applies only for the period and to the people stated when you buy. After it ends, the plan renews at the standard price unless you cancel.
  • Price changes. We may change subscription prices for future billing periods. We will give you advance notice as required by Apple and by law, and where Apple requires it, you will be asked to agree to the new price. If you do not want to pay the new price, you can cancel before it takes effect.
  • Plan features. We may add, improve or adjust features within a plan. If we make a change that materially reduces what you have paid for during a billing period, we will tell you and you can cancel.
05

Cancellation and refunds

You can cancel a subscription at any time in your Apple account’s subscription settings (on iPhone: Settings, then your name, then Subscriptions). Deleting the app does not cancel a subscription. After you cancel, you keep access to paid features until the end of the billing period you have already paid for, and you will not be charged again.

Because purchases are made through Apple, Apple handles payments and refunds under its own terms. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We cannot issue refunds for App Store purchases ourselves, but if you have a problem with Question Avenue, please email us and we will try to help.

Nothing in these terms affects any legal right you have to cancel a purchase or to a refund, for example where digital content is faulty or not as described.

06

Acceptable use

Question Avenue is for personal learning. When you use it, please do not:

  • break any law, or use Question Avenue to harm, harass, threaten or deceive anyone;
  • submit learning goals or questions that seek content that is illegal, sexually explicit involving minors, or intended to help cause serious harm, such as instructions for weapons or self-harm;
  • infringe anyone else’s intellectual property or privacy, including by submitting other people’s personal information without a good reason;
  • copy, scrape, crawl or harvest the app, its content or its data by automated means;
  • use scripts, bots or repeated requests to generate courses or extract AI output at scale, or to build or train a competing product or AI model;
  • reverse engineer, decompile or disassemble the app, except to the extent the law expressly allows this despite this restriction;
  • get around usage limits, free allowances, age checks, subscription checks or security measures, or access systems you are not authorised to access;
  • interfere with or overload the service, or introduce malware or harmful code;
  • resell, sublicense or commercially exploit Question Avenue or its content without our written permission.

We may apply reasonable limits on how many courses, lessons, questions or audio narrations you can generate so the service stays fair and reliable for everyone.

07

Your content

“Your content” means what you give Question Avenue: your learning goals, level, preferences, quiz and revision answers, and the questions you ask about a lesson using Ask. You keep any rights you have in your content.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and adapt your content only as needed to provide, secure and improve Question Avenue for you. This includes sending the necessary parts of it to the AI and hosting providers described in our Privacy Policy to generate, check and deliver your course. The licence ends when your content is deleted, except where we need to keep it for legal or security reasons as the Privacy Policy explains.

You are responsible for your content and confirm that you have the right to submit it. Please do not include sensitive personal information in learning goals or questions unless it is needed for your learning.

08

AI-generated content

Question Avenue uses artificial intelligence to write your course: lesson text, cards, audio narration, quizzes, revision prompts and answers to your Ask questions. Our service checks generated material, but AI-generated content can still be incomplete, out of date or wrong.

  • Question Avenue is for general education. It is not professional advice, and it is not a substitute for a qualified teacher, doctor, lawyer, financial adviser or other professional.
  • Please check important facts against reliable sources before relying on them, especially for health, legal, financial, safety or other high-impact decisions.
  • Question Avenue courses are not accredited qualifications. Your progress in the app shows your activity in the app only.
  • Similar requests can produce similar results, so generated material may not be unique to you.

If you spot something wrong, harmful or inappropriate in a lesson, please tell us at support@questionavenue.com.

09

Ownership and your licence to use Question Avenue

We, or our licensors, own Question Avenue: the app, website, software, design, brand names, logos and our own written material. These terms do not transfer any of those rights to you.

As long as you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the app and the course material generated for you for your own non-commercial learning. You may keep notes and share short extracts with others for personal, educational purposes, but you may not republish or sell generated courses as a product or service.

If you send us feedback or suggestions, we may use them to improve Question Avenue without owing you anything.

10

App Store terms

If you download Question Avenue from Apple’s App Store, your licence to use the app is also governed by Apple’s Standard Licensed Application End User License Agreement and the App Store’s terms, and you must follow those terms as well. In addition:

  • These terms are between you and Megakad XD Ltd, not Apple. We, not Apple, are responsible for Question Avenue and its content.
  • Apple has no obligation to provide maintenance or support for the app. Please contact us for support.
  • If the app fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price for the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for handling any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you as they relate to your licence of the app.

If Question Avenue becomes available on other app stores, similar terms of that store will apply to downloads and purchases made there.

11

Availability and changes to the service

We work to keep Question Avenue available and reliable, but we cannot promise it will always be uninterrupted or error-free. It may sometimes be unavailable for maintenance, updates, problems with our providers or reasons outside our control.

We are always improving Question Avenue, so we may add, change or remove features. You may need to update the app to keep using it. If we stop offering Question Avenue altogether, we will give you reasonable notice where we can, and if you have a paid subscription that ends early because of this, we will explain how to get a refund for the unused period.

12

Ending the agreement

You can stop using Question Avenue at any time. To delete your account, open Profile, then Account, and tap Delete account in the app. Deleting your account does not cancel an App Store subscription, so please cancel that with Apple as well. The Privacy Policy explains what happens to your information.

We may suspend or close your account if you seriously or repeatedly break these terms, if we need to for legal reasons, or to protect other users or the service. Where it is reasonable and lawful, we will tell you why and give you a chance to respond first. If we close your account without a good reason under these terms, we will refund any unused part of a subscription you have paid for.

Sections that by their nature should continue after the agreement ends, such as ownership, disclaimers, liability and governing law, will continue to apply.

13

Disclaimers

We provide Question Avenue with reasonable care and skill. Apart from that, and from any rights that the law gives you and that cannot be excluded, Question Avenue is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will meet every need you have, that generated content will be accurate or complete, or that using it will lead to any particular learning outcome, exam result or qualification.

Question Avenue may link to or cite third-party sources. We do not control those sources and are not responsible for their content.

14

Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Your statutory rights as a consumer are not affected.

If we fail to follow these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Question Avenue is for personal, private learning, so we are not responsible for business losses, such as lost profits, business interruption or lost business opportunities.

Subject to the paragraphs above, and to the extent the law allows, our total liability to you for all claims relating to Question Avenue is limited to the greater of the amount you paid for Question Avenue in the 12 months before the claim arose and £100.

15

Governing law and disputes

If you have a problem, please contact us first at support@questionavenue.com. Most issues can be resolved quickly and informally.

These terms are governed by the laws of England and Wales. If you are a consumer, you also keep the benefit of any mandatory consumer protections of the country where you live, and you may bring proceedings in the courts of England and Wales or in the courts of the country where you live. If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.

16

Changes to these terms and contact

We may update these terms when Question Avenue, our providers or the law changes. The “last updated” date above shows when they last changed. If a change materially affects you, we will give you reasonable notice in the app or by email before it takes effect. If you do not agree to the updated terms, you can stop using Question Avenue and cancel any subscription before they apply.

If any part of these terms is found to be unenforceable, the rest will still apply. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms without our consent; we may transfer ours to another organisation if this does not reduce your rights.
